Compliance & Management

Understand the record. Clarify the next step.

Statutory notices, inspection findings, repair progress and management arrangements can provide useful context for reviewing financed or insured property.

Their value lies in understanding what each record establishes, its current status and the further evidence needed to assess its significance.

Read compliance records in context.

Under Hong Kong’s Mandatory Building Inspection Scheme, owners of buildings aged 30 years or above, except domestic buildings not exceeding three storeys, are required to arrange prescribed inspection and any necessary prescribed repairs when served with statutory notices.

A notice should be considered alongside its scope, deadline, any documented extension and evidence of subsequent action. Inspection, repair completion and the recorded compliance status are related stages that may need to be checked separately.

Where the available information does not establish completion, obtaining further documentation can clarify the position. An information gap, by itself, does not establish a breach.

Management and works arrangements add another dimension.

Maintenance and renovation can improve a building’s condition. The works period also introduces questions about how safety measures are maintained while access, equipment or normal operating arrangements change.

The Fire Services Department states that fire service installations must be kept in efficient working order and inspected by a registered contractor at least once every 12 months. Its guidance also addresses specified shutdowns in scaffolded buildings, including prior permission and interim fire safety measures where the application mechanism applies.

Depending on the circumstances, useful follow-up questions include:

  • Who is responsible for overseeing the works and following up outstanding items?
  • What current inspection and remedial-work records are available?
  • Where safety systems or access arrangements are affected, what temporary measures and restoration checks are documented?

Some answers require documents from owners, managers or contractors; others require assessment by suitably qualified professionals. Public records may not establish whether a particular control is operating effectively.

Understand the relevance to the loan or policy.

For a bank or lender, evidence of repair obligations, associated expenditure or restrictions on use may inform borrower engagement and collateral review.

For an insurer, changes in building condition, use or works arrangements may inform requests for updated risk information and consideration of underwriting or renewal terms.

The significance of a finding depends on its scope, status and the financial or insurance arrangements involved. Evidence of completed remediation is also relevant to that assessment.

Turn records into focused follow-up.

TARA Lighthouse brings official building records and risk signals together to help your team identify matters for review.

An address-list evaluation can provide a starting point for deciding where further documentation, professional assessment or a discussion with the relevant parties would be useful. The scope of the evaluation and available sources determine what can be assessed.

A risk signal is a prompt for review. It does not, by itself, establish that a building is unsafe or non-compliant, predict an incident, or determine a lending or insurance decision.
